Parole Denied

PEOPLE V. JOHN WAYNE CARD: Despite being denied parole for 3 years in 2019, triple murderer Inmate John Wayne Card was given an early parole rehearing on November 17th, 2020 due to recent legislation favoring elderly parole.  The hearing was attended by Deputy District Attorney Michael Coffey who opposed parole on behalf of the People of Glenn County, as well as several members of the victim’s family who were supported by Victim Witness Advocate White.  After a lengthy hearing, the Parole Board again denied parole for 3 years! However, due to the new elderly parole laws, this case is likely to again be granted an early rehearing in 18 months.

 

In 1974, John Wayne Card murdered three members of the Griffiths family; as part of a robbery scheme.  He then kidnapped and held hostage three members of the Skillin family for nearly a week while he attempted to evade law enforcement.  Finally, after abandoning the Skillin family by chaining them to a tree in the forest he was captured near Truckee by a coalition of northern California law enforcement agencies and the FBI.  Inmate Card was convicted at a jury trial and sentenced to death.  However, in 1976 the California Supreme Court ruled that the death penalty statute violated the California Constitution and commuted the death sentences of Inmate Card and approximately 70 other inmates to life in prison.  The statute was later updated to address the constitutional concerns of the California Supreme Court but the commuted death sentences could not be reinstated.

 

The District Attorney’s Office would like to thank the family for their attendance at the hearing and willingness of the 8 family members to speak out against this dangerous killer being released.  We would like to extend a special thank you to the Glenn County Sheriff’s Department and in particular Lieutenant Gibbs who graciously allowed us to use their conference room and their technology to allow the victims to appear at the hearing via video conference due to the California Prison system banning visitors during to the COVID 19 pandemic.

PEOPLE V. DESTINIE FOLSOM - (AS SEEN ON LOVE AFTER LOCK UP!) Defendant was convicted of a felony violation of Penal Code section 4532(b)(1), Escape while serving 2 years for two felony convictions of Penal Code section 530.5, False Impersonation and 1320, Failure to Appear on a Felony Charge. Defendant was sentenced to 16 months prison concurrent to the 427 days remaining on her prison sentence and was remanded to jail today. This case was prosecuted by DA Stewart with assistance from Glenn County Sheriff's Office Sergeants Holley and Draper.

PEOPLE V. DAREN MALLARD - Defendant was previously convicted of a felony violation of Penal Code section 4573(a), Bringing Drugs into the Jail and misdemeanor violation of Penal Code section 148.9, False Information to a Peace Officer. Defendant was also found in violation of probation for the 8th time. Defendant was sentenced to 3 years prison and probation was terminated. This case was prosecuted by DDA Coffey with assistance from Glenn County Probation Department Officer Van Eck.

PEOPLE V. JACOB ALLEN - Defendant was convicted of felony violations of Penal Code section 2800.2(a), Evading a Peace Officer and Vehicle Code section 10851(a), Automobile Theft. Defendant was sentenced to 2 years 8 months prison. This case was prosecuted by DDA Coffey with assistance from CHP Willows Officers Taylor and Cushman. 

PEOPLE V. STEVEN ACEVEDO - Defendant was previously convicted of two separate felony violations of Penal Code sections 4573(a), Bringing Drugs into Jail and was placed on mandatory supervision. Defendant was found in violation of mandatory supervision for the 3rd time. Defendant was sentenced to complete the remainder of his mandaotry supervision time of 678 days in jail. This case was prosecuted by DA Stewart with assistance from Glenn County Probation Officer Perry.

PEOPLE V. MICHAEL ABEL-Defendant was convicted of a felony violation of Penal Code section 459, First Degree Burglary and 211, Robbery. Defendant was sentenced to 365 days jail, drug court, and 3 years probation. This case was prosecuted by DDA Coffey with assistance from Glenn County Sheriff's Office Deputies Turner and Ramirez. 

PEOPLE V. ROBERT KOSCKI- Defendant was convicted of a felony violation of Penal Code section 273.6(d), Violation of a Restraining Order with Priors and misdemeanor 273.6(a), Violation of a Restraining Order. Defendant was sentenced to 321 days jail, 52 week Domestic Batterer's classes with 3 years probation. This case was prosecuted by DDA Coffey with assistance from Glenn County Sheriff's Office Deputy Cordova. 

PEOPLE V. RAYMOND VALLES - Defendant was convicted of felony violations of Penal Code section 29800(a)(1), Felon in Possession of a Firearm and Health and Safety Code section 11366,  Maintaining a Place for Use/Sale of a Controlled Substance. Defendant was sentenced to 180 days jail, drug court, and 2 years probation. This case was prosecuted by ADA Neumann with assistance from CHP Officer Williams.

PEOPLE V. ADALBERTO ANGEL- Defendant was previously convicted of felony violations of Penal Code section 273.5(a), Corporal Injury to a Cohabitant and was found in violation of probation. Defendant was sentenced to 180 days jail and probation was reinstated. This case was prosecuted by DDA Coffey with assistance from Probation Department Officer Ortiz. 

PEOPLE V. JOSE LUIS GARIBAY - Defendant was previously convicted of felony violations of Penal Code section 245(a)(1), Assault with a Deadly Weapon and misdemeanor Domestic Violence and was found in violation of probation. Defendant was sentenced to 150 days jail and probation was reinstated. This case was prosecuted by ADA Neumann with assistance from Probation Department Officer Ortiz. 

PEOPLE V. VICTOR DELGADILLO - Defendant was convicted of two felony violations of Penal Code section 246.3(a), Unlawful Discharge of a Firearm. Defendant was sentenced to 120 days jail and 2 years probation. This case was prosecuted by DA Stewart assistance from Glenn County Sheriff's Office Deputy Ayres.

PEOPLE V. JOHNATHAN HANSON - Defendant was convicted by a jury of a misdemeanor violation of Health and Safety Code section 11364(a), Possession of a Drug Paraphernalia and was found in violation of probation for the 2nd time. Defendant was sentenced to 120 days jail. The case was prosecuted by DDA Coffey with assistance from Glenn County Probation Officer Van Eck.

PEOPLE V. JORGE CORTEZ-CERVANTES- Defendant was convicted of misdemeanor violations of Penal Code sections 243(e)(1), Domestic Battery and Vehicle Code section 14601.2, Driving with a Suspended License. Defendant was sentenced to 90 days jail, 52 week Batterers Treatment Program classes, and 3 years probation. This case was prosecuted by DDA Coffey with assistance from Glenn County Sheriff's Office Deputy Lourenzo and CHP Willows Officer Vasquez.

PEOPLE V. ANTINAZIA VALERIO- Defendant was convicted of misdemeanor violations of Penal Code sections 245(a)(1), Assault with a Deadly Weapon, Hammer, and 273.5(a), Corporal Injury to Father of her Children. Defendant was sentenced to 60 days jail, 52 week Batterers Treatment Program classes, and 3 years probation. This case was prosecuted by ADA Neumann with assistance from Glenn County Sheriff's Office Deputies Ramirez, Thompson, and Goodwin and CHP Willows Officers Gilliam and Taylor. 

PEOPLE V. SUE KEMP - Defendant was previously convicted of felony violations of Penal Code section 245(a)(1) and 273.6, Assault with a Deadly Weapon and Violating a Restraining Order and Defendant was found in violation of probation for the 3rd time. Defendant was sentenced to 60 days jail and probation was reinstated. This case was prosecuted by DDA Coffey with assistance from Glenn County Probation Officer Van Eck. 

PEOPLE V. BRADLEY WHITMER - Defendant was convicted of a misdemeanor violation of Fish and Game Code section 3800, Taking a of Non-Game Bird, a Pelican. Defendant was sentenced to 1 year court probation, $1710 fine, and 1 year hunting restriction. This case was prosecuted by DDA Coffey with assistance from United States Federal Fish and Wildlife Officers Crenshaw and Kemp.
